Role of the ARC

The role of the ARC is to:

1. Assure that the rules regarding the external appearance of members’ properties contained in the following Autumn Woods documents are adhered to:

a. Article 8, Architectural Control and Article 9, Use Restrictions, of the Master Association Declaration of Covenants, Conditions And Restrictions.

b. Article 8, Architectural Control, and Article 10, Use Restrictions, of the Neighborhood Associations Declarations of Covenants, Conditions And Restrictions.

c. Autumn Woods January 2008 Homeowners Manual (the 2008 Community Association Rules And Regulations document approved at the January 23, 2008 Board of Directors Meeting, and any subsequent Board approved amendments).


2. Assure that Collier County landscaping requirements are adhered to when considering members’ requests for external modifications.

3. Assure that the rights and privileges conveyed to members by Florida Statute 720.303 and 720.3035 and by Autumn Woods’ documents are not infringed upon by acknowledging members’ rights to make decisions on the external appearance of their properties on matters for which there are no legally established rules that are specific as to location, size, type and appearance.

4. Assure that personal preferences, likes and dislikes of ARC members are not a factor in ARC determinations.

5. Administer ARC procedures regarding the review of members’ requests for external appearance modifications and members’ nonconformance with external appearance rules.

6. Appraise the Board of Directors of ARC issues requiring their attention.

7. Recommend, for Board of Directors consideration, modification of existing or establishment of new external appearance rules as deemed appropriate.
